Maryland “Robo Signing” Lawsuit Thrown Out – Balt Sun Article

Maryland Federal Judge ruled that the plaintiffs should have filed while their home was in the foreclosure process.  Plaintiffs lawyers refused to respond. The plaintiffs argued that the Robo Signing scandal wasn’t made public until after their foreclosure.  Both parties agreed that the homeowners were late and delinquent in payments and that the foreclosure was proper. The class-action suit was filed after a former paralegal at the defendant Shapiro & Burson, a law firm based in Virginia that has handled many Maryland foreclosure cases in recent years, complained to regulators and prosecutors, alleging that robo-signing there was routine.

From Wikipedia: In an October 21, 2010 Wall Street Journal Article titled “Niche Lawyers Spawned Housing Fracas” the Journal reports that foreclosure lawyer/advocates, Thomas Ice and Matthew Weidner, were discussing the deposition testimony of mortgage company employees. “Tom and I were talking, and it was, ‘Jesus, they’re like robots!'” Mr. Weidner says. Mr. Weidner, a blogger, on January 8, 2010 wrote a blog post with an appellation for the routine signers. “We know from depositions taken of these ‘robo signers,'” he wrote, “that they don’t even read the documents placed in front of them and the notaries and witnesses that are supposed to watch them as they sign are not present.”

Robo Signing may date all the way back to the 1990s. “Because of these bad titles, property owners can’t prove they own the properties they think they bought, and banks can’t prove they had the right to sell them,” states one article wriiten about robo signing.
